Nillable on element ref .... XERCES: ERROR vs XSV: Legal ... which is correct?

Nillable on element ref .... XERCES: ERROR vs XSV: Legal ... which is correct?

Hi Folks,
 
XERCES says this is illegal: 
 
<element ref="Title" nillable="true"/>

XERCES gives this error message: Attribute 'nillable' cannot appear in
element 'element'
 
XSV says it's legal.
 
Who's correct?  /Roger
